GENERAL TERMS OF SALE

1. GENERAL PROVISIONS

These General Terms of Sale govern the conditions of purchase through the Dietpharm webshop (“Webshop”, “Seller”).

By placing an order through the Webshop, the user (“Customer”) accepts these Terms.

These Terms are in accordance with the Consumer Protection Act (NN 19/22, 59/23) and the Electronic Commerce Act.

3. PRODUCTS – FOOD SUPPLEMENTS

The Dietpharm webshop sells food supplements, which are placed on the market in accordance with Croatian regulations and EU legislation (Directive 2002/46/EC; Rulebook on Food Supplements).

All products clearly display ingredients, usage instructions, and directions.

Products are not medicinal products and are not intended for the diagnosis, treatment, or prevention of diseases.

4. ORDER AND CONTRACT FORMATION

An order is considered received when the Customer electronically confirms the cart.

The contract is concluded at the moment the Seller sends an order confirmation to the Customer’s email address.

The Dietpharm webshop reserves the right to refuse an order (e.g. in case of product unavailability).

5. PRICES AND PAYMENT METHODS

All prices are expressed in EUR, include VAT, and are clearly indicated with each product.

Only card payments are accepted. The Seller reserves the right to change prices until the order is confirmed.

6. DELIVERY

Delivery is carried out by contracted courier services (e.g. DPD, GLS), in cooperation with a micro-logistics partner.

Delivery times are typically 1–3 business days within Croatia.

Order status is tracked via automatic notifications and track & trace links.

7. RECEIPT OF SHIPMENT

The Customer is required to inspect the package upon delivery.

If the packaging is damaged, the Customer should immediately notify the courier and may refuse acceptance.

8. RETURNS AND COMPLAINTS

The Customer has the right to returns in accordance with the Consumer Protection Act.

8.1. Right of Withdrawal (14 Days)

The Customer may withdraw from the contract within 14 days without stating a reason, except for products:

  • that have been opened – due to sanitary reasons, returns are not possible (food supplements fall into the category of products that come into direct contact with the body and cannot be returned once unsealed).

This is based on EU and national regulations for products with hygiene-related risks.

8.2. Return Procedure

  • The Customer sends a notification to info@dietpharm.com
  • The product must be returned in its original, undamaged packaging
  • Returns are received at the micro-logistics warehouse, where they are separated and processed

8.3. Complaints

If an incorrect or damaged product is received:

  • The Customer sends a photo and description of the issue
  • The Seller provides a replacement or refund

9. LIABILITY FOR MATERIAL DEFECTS

The Seller is liable for material defects in accordance with the Obligations Act.

We are not responsible for improper use of products or failure to follow instructions.

10. PERSONAL DATA PROTECTION

Personal data is processed in accordance with the Dietpharm Privacy Policy and GDPR.

Supervisory authority: Croatian Personal Data Protection Agency (AZOP).

11. COOKIES

By using the Webshop, the Customer agrees to the terms of the Cookie Policy.

12. CONTENT LIABILITY

Dietpharm reserves the right to modify information on the website (composition, description, price, availability), while ensuring accuracy and updates.

13. RIGHT OF WITHDRAWAL BY THE SELLER

The Seller may terminate the contract if:

  • The Customer provides false information
  • Payment is not completed
  • There is suspicion of misuse

14. DISPUTE RESOLUTION

We aim to resolve disputes amicably.

If this is not possible, the court with jurisdiction over the Seller’s registered office shall be competent.

15. FINAL PROVISIONS

These General Terms are valid from the date of publication on the Webshop.

The Seller may amend them; changes take effect upon publication.
